Модель захисту в суді інформаційних прав і свобод людини відповідно до вимог демократії

Abstract

У статті запропоновано модель захисту в суді інформаційних прав і свобод людини відповідно до вимог демократії. Модель усуває різноманіття в застосуванні принципів Європейського суду з прав людини суддями національних судів. На перший план роботи національного суду у відстоюванні інформаційних прав і свобод людини виходить демократія. Це забезпечує єдино правильний підхід до розгляду справ про порушені інформаційні права і свободи людини, результатом яких є безпомилкові рішення. Модель усуває невпевненість учасників судового процесу в правильності застосування демократичних принципів, вироблених Європейським судом з прав людини. Як і будь-яка модель, запропонована підлягає автоматизації (комп’ютеризації). Після практичної реалізації моделі вдасться полегшити роботу національних судів. The author created a model of protecting human information rights and freedoms in the court in accordance with the requirements of democracy. The proposed model eliminates ambiguity in the use of the principles of the European Court of Human Rights by the judges of national courts. Democracy is at the forefront of national courts work in defending information rights and freedoms. The model eliminates the uncertainty of the trial participants concerning the appropriate application of the democratic principles, developed by the European Court of Human Rights. Like any other model, the proposed by the author needs automation. Created by the author model of protecting information rights and freedoms in the court in accordance with the requirements of democracy allows to regulate the whole set of current normative legal acts in the information sphere, ensures the harmonization of the Ukrainian laws with the precedents of the European Court on Human Rights, promotes the reforming of national legal proceedings.
