Сучасна українська правова наука: деякі проблеми та перспективи

Abstract

У статті аналізуються висловлені у науковій літературі точки зору щодо понять «наука» та «правова наука»; виявляється природа науки як соціального явища; встановлюється місце правової науки в її структурі; виокремлюються характерні для неї ознаки; формулюється визначення поняття як системи наукових знань про закономірності становлення, функціонування та розвитку правових явищ та способів і засобів конструювання правової дійсності. Виявляються проблеми функціонування та розвитку сучасної правової науки в Україні: її депарадигмальність, відсутність чітких науковознавчих критеріїв; методологічна недосконалість та пропонуються способи їх розв’язання: посилення інноваційних напрямів наукових досліджень; створення нових наукових парадигм; формування сталої, дієвої методологічної основи.The article analyzes various points of view regarding the concepts of «science» and «legal science» interpretation in the scientific literature, assuming the lack of unified approaches to their understanding and interpretation. In the focus of attention are the typical features of both science in general, and legal science in particular, the nature of science as a social phenomenon and the place of legal science in its structure including quintessential characteristics of legal science. The analysis has laid the foundation for the definition of legal science as a system of scientific knowledge of the laws governing the formation, operation and development of legal phenomena, as well as the methods and means of constructing legal reality. The importance is placed on the problems of functioning and development of modern science of law in Ukraine: its deparadigmality, lack of clear scientific criteria and its methodological imperfection. The article considers possible ways of improving the situation in the Ukrainian legal science, which imply enhancement of innovative research studies, creating new scientific paradigms and developing stable, effective methodological foundations for this.
